DMCA Policy

Students and teachers can upload and post content on Limud - assignment file uploads (documents, images, PDFs), forum and study-group posts, and shared whiteboards. Limud Education Inc. ("Limud") respects the intellectual property rights of others and expects users of our platform to do the same. This policy explains how to report content you believe infringes your copyright, and our response procedure under the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512.

1. Designated Agent

Notices of claimed copyright infringement should be sent to our designated agent:

Notices sent to any other address or department may not be processed in a timely manner.

2. What a Valid Takedown Notice Must Include

To be effective under the DMCA, your notice must include, in writing:

  1. a physical or electronic signature of the copyright owner or someone authorized to act on their behalf;
  2. identification of the copyrighted work you claim has been infringed;
  3. identification of the material you claim is infringing, and information reasonably sufficient for us to locate it (for example, a URL, or the course/assignment/forum post it appears in);
  4. your contact information, including your address, telephone number, and email address;
  5. a statement that you have a good-faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law; and
  6. a statement, made under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf.

3. Our Response

On receiving a valid notice, we will remove or disable access to the identified material, notify the user who posted it, and provide that user with a copy of the notice, as the DMCA requires.

4. Counter-Notification

If your content was removed and you believe this was a mistake or misidentification, you may submit a counter-notice to legal@limud.co that includes:

  1. your physical or electronic signature;
  2. identification of the material that was removed and its location before removal;
  3. a statement, under penalty of perjury, that you have a good-faith belief the material was removed as a result of mistake or misidentification;
  4. your name, address, and telephone number; and
  5. a statement that you consent to the jurisdiction of the federal court in your district (or, if outside the U.S., an appropriate judicial district), and that you will accept service of process from the person who filed the original notice.

Unless the original complainant files a court action seeking to restrain the user from engaging in the infringing activity, we may restore the removed material within 10-14 business days of receiving a valid counter-notice.

5. Repeat Infringers

We may, at our discretion, suspend or terminate the account of a user who is the subject of repeated, valid infringement notices.

6. Misrepresentation

Under the DMCA, anyone who knowingly materially misrepresents that content is infringing, or was removed by mistake, may be liable for damages.
